General terms and conditions

Included in the price:

  • VAT and taxes included

  • 2 hour period of grace from the time of collection

  • Unlimited mileage

  • Coverage against theft of vehicles

  • Personal Injury Assistance (PAI)

  • Full risk insurance with excess

The amount for the excess or deductible will vary depending on the category of the vehicle. In the case that the customer does not wish to contract the collision damage waiver insurance (CDW) to cancel the excess, he/she must leave a deposit to cover possible damages not covered by the insurance. The amounts varry according to the car category:

  • Groups A, B, C, C1, CC, J: €900

  • Groups C+, D, D1, D+, E, F, EE, EE1,: €1100

  • Groups D+,G, H, K, L, M: €1600

THIS DOES NOT AFFECT THE VIP RATE (VIP CDW is included)

This deposit will be charged on the clients credit card upon pickup. If the customer returns the vehicle in the same condition in which it was collected, we will proceed to the return the deposit. Damages caused to the vehicle that are not covered by the insurance will be charged against the deposit.

Arash Rent a car SL is not responsible for the fees charged by your bank upon the return of the deposit to your credit card.

The concerted third party insurance covers the renter and authorized drivers against liability by amount of seventy million euros (70.000.000.- €).

Only the person(s) included into the insurance and listed on the contract are allowed to drive the vehicle.

Insurance “Young driver” for drivers between 21-24 years old: €12/day

  • In these cases there is no possibility to cancel the excess (CDW) or choose the full coverage insurance (SCDW)

  • One year driving license minimum experience

  • Hiring is only allowed for groups A, B, C, C1, CC

  • This rule is valid until the 25th birthday

Insurance “Senior driver” for drivers over 75 years old: €12-16/day

  • In these cases there is no possibility to cancel the excess (CDW) or choose the full coverage insurance (SCDW)

  • This rule is valid starting the 76th birthday

  • The maximum age is 88 years

Not included in the price and considered extras:

The CDW insurance to cancel the excess:

  • Groups A, B, C, C1, CC, J: €12/day or €240 maximum per rental contract

  • Groups C+, D, D1, E, F: €14/day or €280 maximum per rental contract

  • Groups D+, EE, EE1, G, H, K, L, M: €16/day or €320 maximum per rental contract

  • The maximum rental period per contract is 30 days.

  • The CDW does not cover damages to tyres, wheels, glass, and mirrors.

OUR VIP RATE INCLUDES THE CDW INSURANCE

For you complete tranquility, we offer the SCDW insurance which covers all types of damages (except the damages listed below)

  • Groups A, B, C, C1, CC, J: €16/day o €320 maximum per rental contract

  • Groups C+, D, D1, E, F: €20/day o €400 maximum per rental contract

  • Groups D+, EE, EE1, G, H, K, L, M: €24/day o €480 maximum per rental contract

  • The maximum rental period per contract is 30 days.

Not covered by insurance:

It is the resposibility of the customer the following cases of loss or damage:

  • Loss or damage to keys

  • All costs caused due to wrong type of fuel being administered to the vehicle

  • Damages under the vehicle

  • Loss of accessories or parts inside or trunk

  • Towing service (only when the customer incurs in negligence that is not covered by insurance)

  • Damage to clutch

  • Damage or loss of antenna

  • Damages inside the car

  • Damages on the roof of convertible cars

Breakdowns, accidents, and Road side assistance

In the event of a breakdown, the client will have the right to a replacement vehicle as long as its repair is not possible in a reasonable time and under the supervision of the technical staff of Arash rent a car. In the event that a replacement is not possible, the customer has the right to a refund of the amount of the days not consumed.

The client will have no right to any refunds of any expenses or repairs made to the vehicle, without a prior authorization of Arash rent a car.

In the event of an accident or damage to the vehicle, it is mandatory for the client to fill in the accident / damage report and deliver it to our office. Likewise, in the event of the theft of the vehicle, the client is obliged to report it to the Police and deliver the report to our office. Any accident or damage to the vehicle that is not notified will be interpreted as negligence on the part of the client and this may incur to additional expenses for the client.

In the event of an accident, the customer is not automatically entitled to a free replacement vehicle, and this will depend on the circumstances of each case. If the client is the cause of the said accident, he will have to pay a new rental contract for replacement vehicle.

However, the client will be entitled to a free substitution vehicle if the client has contracted the Road Assistance insurance.

The client will not be entitled to a subsitution car under any circumstances, if this is due to the client′s misuse or negligence. Neither will any amount be reimbursed for the aforementioned concept.

Our vehicles are equiped with a spare tyre or an anti-puncture kit. If the client has not contracted roadside assistance, it is the clients resposibility to change or repair the tyre in the event of a puncture or damage.

Without the roadside assistance insurance, any assitance or intervention by the Arash rent a car technical staff or associated companies will be charged to the client.

The cost of the interventions of the technical staff of Arash rent a car is calculated from the departure from our office to the place of assistance and back, being €50 the minumum cost, and €50/hour after the first hour.

The towing costs can vary from €150 – €500 depending on the distance, time, and location of the intervention.

Extras

Additional Drivers: € 4 / day. Maximum of € 40 per driver per hire period

Any accessory GPS, child seats, etc .. Prices are available to the customer at the time of booking on our website.

Credit cards

VISA, Mastercard, and American Express are accepted. Both, the excess and the return of the excess deposit, should always be done with credit cards.

Authorization to charge amounts with credit card

By communicating the data of the credit or debit card at the time of the formalization of the reservation or contract, the customer authorizes Rent a car Arash SL to charge this card with the price of the rent , the excess, and any other cost and liability collected under these conditions are accrued in connection with the rental agreement.

Once the client has confirmed the reservation, Arash Rent a car SL will be able to charge the credit or debit card with the entire foreseeable rental price, including the extras requested.

By confirming the reservation, the customer accepts explicitly the rental conditions available on this website, without the need to sign the rental contract that remains inside the vehicle for pick-ups at the airport.

The reservation of the vehicle or the rental contract will be rendered ineffective in the event that it’s not possible to charge the card.

Cancellation policy

Cancellations without penalty must be made with a minimum of 96 hours respect to the start of rent which shall be considered at 08.00 am on the first day.

Otherwise the following will apply:

– Between 96 and 72 hours, 25% of the total agreed price will be paid.

– Between 72 and 48 hours, 50% of the total agreed price will be paid.

– Between 48 and 24 hours, 75% of the total agreed price will be paid.

– Less than 24 hours, 100% of the total agreed price will be paid.

Restrictions

  • The vehicle can only be driven in Mallorca and the contract must always be onboard

  • Customers will need to provide us with a local address (flat, apartment, villa, hotel, etc.)

  • The minimum driver age is 21 years, with a driving license with a length of more than 12 months

  • The maximum driver age is 80 years and for drivers over 75 years there is no possibility to cancel the excess

  • If the renter/payer is not the primary driver, it is mandatory to acquire the SCDW full coverage

  • It′s only possible to book a vehicle category and not a concrete brand or model. If the vehicle category reserved is not available at the time of collection, we will provide one upgrade at no additional cost

  • The insurance does not cover, in any case, accidents or damages caused to the vehicle by driving under the influence of alcohol, drugs, medications or any other substance that reduces the driver′s ability, or when the driver is not one of the authorized drivers in the contract, or even so, if the damages occur due to breach of what is established in the contract or the basic traffic regulations.

  • The transport of goods or animals may be only with the express consent of Arash Rent a car SL. Non-observance of this regulation can be a special cleaning, provided the customer with up to €95

No smoking!

It’s not allowed to smoke inside our vehicles. Non-observance of this regulation can be a special cleaning, provided the customer with up to €95 and an additional cost of € 30 per day that the vehicle was stopped to clean the complete interior, due to strong tobacco smell.

Fuel policy

If specifically requested by the cliente, we can offer the vehicle with a full tank of fuel, for which we will charge in advance a deposit as seen on the table below. This deposit will be returned to the customer, once the car is returned with a full tank.

As an alternative and by defect, we can deliver the car with minimum a 1/4 tank of fuel, and the client can return it the same way, without having to leave a deposit.

In either case, if the customer returns the car with less fuel than agreed, he/she needs to pay for the missing fuel plus a 20€ service fee.

GROUP: A = 80€

GROUP: C + CC + J = 85€

GROUP: D + E + F + K = 100€

GROUP: G + H + M = 120€

GROUP: L = 140€

Rates may change, depending on the increases and / or decreases in fuel prices.

Traffic Fines

The customer will be held totally and absolutely responsible for any fines, sanctions, or any other measures which are applied to the hired vehicle because of improper use and will be subjected to the tribunals of Palma de Mallorca.

Rent a car Arash is obliged by law to provide informations of the renter to the authorities in case of a traffic fine and charges an administrative fee of 25 Euros (VAT included) to the customer when we receive a traffic ticket.

This fee does not include the payment of the traffic fine. The customer will receive the fine by mail and must pay the authorities directly.

Pick up at the airport

The customer will pay the parking fee at Palma airport at the time of collection. The amount of the ticket should not exceed 5€, and if it does the client can claim the amount exceeded except in deliveries between 22:00 to 8:00, when it can reach up to 30€.

Car return at the airport

Arash Rent a car S.L will pay the parking fee when the customer returns the vehicle at the termination of his contract. For car returns between 22:00 and 08:00 there is an “airport late night” fee of 30€.

Delivery charges for Bookings of less than 3 days

For bookings of less than 3 days with delivery outside our office in Portals Nous, or delivery in one place and return in another place, the client will be charged a “delivery service” of 30€. For rentals of 3 days or more this service is free.

IMPORTANT! We don’t deliver or collect cars inside the ACIRE areas in Palma!

Early car return

The early return of the vehicle will not be cause for early refund

Late return of the vehicle

If the vehicle is returned later than the date agreed in the contract, the insurance will be invalidated, and the customer will be responsible for payment of € 30.25 per day (VAT included). In addition to this payment, the customer will also be responsible for paying the daily rental rate.

Abandonment of the vehicle

Clients abandoning vehicles elsewhere than the agreed in the lease shall be liable for costs incurred for breach of contract. Moreover, apart from the daily rental fee, a daily charge of € 30.25 (VAT included) penalty will apply.

Standard or extreme cleaning

The rental price includes a standard cleaning of the vehicle, however, if the vehicle is returned extremely dirty or with strong tobacco smell, Arash Rent a car SL will be forced to charge up to €95 for special cleaning and an additional cost of € 30 per day that the vehicle was stopped, due to strong tobacco smell.

Exclusion of Warranties and Liability – Force Majeure – Jurisdiction

1. Interruption of the Portal and Services

RENT A CAR ARASH SL reserves the right to temporarily interrupt access to the Portal, as well as the provision of any or all of the Services offered through it, at any time and without prior notice, where necessary for technical reasons, security, maintenance, control, power failures, or any other circumstances beyond the reasonable control of RENT A CAR ARASH SL.

RENT A CAR ARASH SL shall not be liable for interruptions, delays, errors, malfunctions or, in general, any other inconvenience affecting the Services where such circumstances arise from causes beyond the reasonable control of RENT A CAR ARASH SL, from any malicious or negligent action or omission by the User, or from an event of Force Majeure.

2. Force Majeure

For the purposes of these Terms and Conditions, and without prejudice to Article 1105 of the Spanish Civil Code, Force Majeure shall include any event or circumstance occurring outside the reasonable control of RENT A CAR ARASH SL which could not reasonably have been foreseen or, if foreseeable, could not reasonably have been prevented or overcome.

Such circumstances may include, without limitation, war, threat of war, acts of terrorism, civil unrest, governmental measures or restrictions, strikes, fuel shortages or interruptions in fuel supply, pandemics or epidemics, natural disasters, extreme weather conditions, fire, flooding, power failures, interruptions to transport or infrastructure, failures of third-party operators or suppliers, acts or omissions of Public Authorities, restrictions on access to roads or destinations, cyber-attacks or other attacks on the security or integrity of computer systems, provided that RENT A CAR ARASH SL has adopted reasonable security measures appropriate to the circumstances.

3. Prepaid Bookings Affected by Force Majeure

Where, as a direct consequence of an event of Force Majeure, RENT A CAR ARASH SL is unable to provide the vehicle or Services booked by the User, the situation shall not be treated as a voluntary cancellation by RENT A CAR ARASH SL or as a cancellation by the User.

In such circumstances, RENT A CAR ARASH SL shall not be required to provide an immediate cash refund solely as a result of the occurrence of the Force Majeure event, to the extent permitted by applicable law.

Any amount already paid by the User in respect of the affected booking shall remain fully credited to the User and shall not be forfeited. RENT A CAR ARASH SL may offer the User an alternative rental date, subject to vehicle availability and the applicable booking conditions, or otherwise retain the amount paid as a credit towards a future booking.

The credit shall be valid for 12 months from the original scheduled start date of the affected rental and may be used by the User towards a future rental booking with RENT A CAR ARASH SL, subject to vehicle availability and the applicable booking conditions.

Where the price of the new booking is higher than the amount of the credit, the User shall pay the difference. Where the price of the new booking is lower than the amount of the credit, the remaining balance shall continue to be available to the User until the expiry of the original 12-month credit period.

The credit shall not be transferable to another person unless expressly agreed otherwise by RENT A CAR ARASH SL.

Nothing in this clause shall exclude or limit any mandatory right to a refund or other remedy that the User may have under applicable consumer protection legislation.

4. Limitation of Liability

In circumstances covered by Force Majeure, RENT A CAR ARASH SL shall not be liable for losses, costs, delays, inconvenience or damages arising directly or indirectly from the inability or delay in providing the Services, except where such liability cannot legally be excluded or limited.

To the extent permitted by applicable law, RENT A CAR ARASH SL shall not be liable for indirect or consequential losses, loss of profits, loss of business, loss of opportunity or other consequential damages arising from circumstances beyond its reasonable control.

5. Third-Party Services and Links

RENT A CAR ARASH SL does not guarantee or assume responsibility for any damage or loss arising from access to third-party services through connections, links or linked websites.

The purpose of any links appearing on the Portal is exclusively to inform the User about the existence of other sources of information or services available on the Internet. RENT A CAR ARASH SL does not control and is not responsible for the legality, availability, accuracy, quality or content of third-party websites or services.

Accordingly, the User should exercise appropriate caution when accessing and using information or services provided by third parties.

6. Viruses and Harmful Elements

RENT A CAR ARASH SL excludes, to the extent permitted by applicable law, any liability for damages of any kind that may arise from the presence of viruses, malware or other harmful elements in content or websites which may cause alterations to computer systems, electronic devices, documents or data stored on them, provided that RENT A CAR ARASH SL has adopted reasonable security measures appropriate to the circumstances.

7. Exercise of Data Protection Rights

Users may exercise their rights of access, rectification, erasure, objection, restriction of processing, portability and any other rights recognised under applicable data protection legislation by contacting RENT A CAR ARASH SL through the contact details provided in the Privacy Policy.

8. Applicable Law and Jurisdiction

These Terms and Conditions shall be governed by applicable Spanish law.

Where the User acts as a consumer, nothing in these Terms and Conditions shall affect any mandatory rights or protections granted to the User under applicable consumer protection legislation, including any mandatory rules concerning jurisdiction.

For Users who do not act as consumers, the parties shall submit to the jurisdiction of the competent courts in accordance with applicable Spanish law.

APPLICABLE LAW AND JURISDICTION.

These general conditions shall be governed by and interpreted in accordance with Spanish law in all matters not expressly established herein. The parties submit to the jurisdiction of the competent Courts and Tribunals for any questions that may arise or actions that may be brought as a result of the provision of the website service and its services and contents, and regarding the interpretation, application, fulfilment or non-fulfilment of the provisions of these general conditions.

If the user is considered to be a consumer, the competent Courts and Tribunals will be those provided for in the provisions of current legislation governing consumer protection.
